General Terms and Conditions of Use and Sale

These General Terms and Conditions of Use and Sale (the “Terms”) govern access to the website guide-immo-thailande.com (the “Service”), operated by Guide Immo Thaïlande (“we”, the “Publisher”), and the subscription to paid Pro Area plans. Any use of the Service implies full and unreserved acceptance of these Terms.

The Service is a real estate marketplace dedicated to Thailand, connecting buyers / tenants with sellers / real estate agents. The Service includes:

• Browsing and searching real estate listings.
• Publication of listings by professional agents (Pro Area).
• Internal messaging between users.
• A marketplace for professional services (lawyers, concierge services, rental management).
• Additional tools (valuation, loan calculator, alerts).

The Publisher acts as a technical intermediary and is in no way a party to the real estate transactions concluded between users.

When registering, users undertake to provide accurate, complete and up-to-date information and to keep their login credentials confidential. Each account is strictly personal. Users acknowledge that they are solely responsible for all actions carried out from their account.

Registration is reserved for natural persons of legal age with full legal capacity, or for legal entities represented by a duly authorised representative.

In particular, users undertake to:

• Comply with applicable Thai and international legislation.
• Publish only genuine and accurate listings that comply with land law.
• Not use the Service for fraudulent or illegal purposes or for money laundering.
• Not infringe the rights of third parties (privacy, trademarks, copyright).
• Not attempt to circumvent technical protection measures.
• Pay on time any amounts due under the subscriptions taken out.

Any listing may be moderated before or after publication. We reserve the right to refuse or remove, without notice or compensation, any listing that is fraudulent, does not comply with the law, or breaches our publication rules.

The Plus, Premium and Gold subscriptions are described on the Pricing page. Unless cancelled, the subscription renews automatically at the end of each period. Payment is due monthly and is collected automatically.

In accordance with European legislation applicable to consumers, the 14-day right of withdrawal applies as long as the user has not started actively using the paid features. Thereafter, refunds are calculated pro rata to the unused period.

Payments are processed by Stripe, which is PCI-DSS certified. No banking data is stored by the Publisher. If a payment collection fails, two reminders are sent before the paid account is suspended.

All elements of the Service (graphic identity, logo, source code, database, editorial texts, photographs) are protected by the intellectual property laws in force, both in Thailand and in the European Union. Any unauthorised reproduction is strictly prohibited.

Users who publish content (listings, photos) grant the Publisher a non-exclusive, worldwide, royalty-free licence to use such content for the purposes of the Service and its promotion (social networks, email campaigns, media partnerships).

The Publisher is bound by an obligation of means and not of result. It accepts no liability for the accuracy of information published by users, nor for the conclusion or performance of real estate transactions.

The Publisher cannot be held liable for indirect or intangible damage (loss of opportunity, loss of profit, damage to reputation). Where its liability is incurred, it is limited to the amounts actually paid by the user in the 12 months preceding the event giving rise to the claim.

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

An account may be suspended or terminated, without notice or compensation, in the event of a serious breach of these Terms (fraud, false listings, unpaid amounts, unlawful content). Users may close their account at any time from their dashboard. Termination results in the deletion of active listings when the paid period expires.

The Service evolves regularly. The Publisher reserves the right to modify the features offered at any time. These Terms may be amended; any substantial change will be notified 30 days before it takes effect. Continued use after such notification constitutes acceptance.

Neither party may be held liable for a failure resulting from an event of force majeure within the meaning of Thai and French case law (natural disasters, pandemics, government decisions, major cyber-attacks, etc.).

These Terms are governed by Thai law. In the event of a dispute, and after a mandatory attempt at amicable settlement, the competent court shall be that of Pattaya, Chonburi, Thailand.

For consumer users residing in the European Union, the law of their country of residence remains applicable where its mandatory provisions so require. Cross-border disputes may be submitted to the European Online Dispute Resolution (ODR) platform.
